Aids for the definite paralyzation of fishing l’activitat of the modality d’arrossegament, encirclement, trawl line of surface and minor arts of the Balearic Islands, year 2010

The definite paralyzation of fishing l’activitat of boats of fishing will be subvencionable of the modalities d’arrossegament, encirclement, trawl line of surface and minor arts, that fulfill the foreseen requirements to the call, always that estiguen affected by l’Ordre ARM/143/2010, of 25 January, for which s’estableix an integral Plan of management for the conservation of the fishing resources of the Mediterranean, modified by l’Ordre ARM/2023/2010, of 14 July, and that is carried out by one of the following means:
a) The disruption of l’embarcació.

c) Destination to non fishing tasks of yielding character.

In the cases of the sections c), d) and e), the boats will not be able to change to the lists quart and seventh of the Register of boats.

Addressees

The physical or juridical persons, communities of goods or any other type d’agrupació that carry out the foreseen performances to the present Resolution and that, in the moment of presentation of the sol•licitud d’ajuda, they are owners of fishing boats.

Requisites

b) Have d’estar inscribed to the Third List of the official Register of registration of boats and in the census of the Operating Fishing Fleet.

e) Have d’estar free of loads and taxes. For the purpose of concession, n’hi have enough that se’n guarantees the cancel•lació or presents express authorization of credit l’entitat by which the definite paralyzation is allowed.
f) Not have d’estar offered as a casualty for a new construction.

Six months.

Maximum deadline for the notification

The maximum deadline to notify the express resolution it is from six months, from l’acabament of the deadline of presentation of sol•licituds and s’ha of notifying individually to the interested persons. This time gone by without having notified the express resolution to itself, the interested person will be able to understand as rejected its sol•licitud.

Presentació de sol·licituds


    Les persones interessades que compleixin els requisits prevists en aquesta convocatòria podran presentar les sol•licituds, que hauran de tenir el contingut mínim que figura a l’annex I, que hauran d’anar adreçades al president del Fons de Garantia Agrària i Pesquera de les Illes Balears i s’hauran de presentar en el registre del FOGAIBA, en el registre de Presidència o a qualsevol dels registres que preveu l’article 38.4 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú.

    Periods: El termini de presentació de sol•licituds de les ajudes, convocades mitjançant aquesta Resolució, serà des del dia següent de la data de la seva publicació i acabarà 13 de desembre de 2010.

    Documentation:
    Aquestes sol•licituds han d’anar acompanyades de la següent documentació:
    a) Fotocòpia compulsada del DNI, NIF o NIE del sol•licitant.
    b) Fotocòpia compulsada del DNI del representant legal, si n’és el cas.
    c) Fotocòpia compulsada del document constitutiu de l’entitat o estatuts socials degudament inscrits en el registre corresponent o certificat d’inscripció registral dels documents esmentats.
    d) Document acreditatiu de la representació amb què actua qui signa la sol•licitud, si n’és el cas. Aquesta acreditació ha d’estar en vigor en el moment de la sol•licitud.
    e) En el cas d’agrupacions sense personalitat jurídica, també s’ha d’aportar:
    - Document en què es reflecteixin les normes o la reglamentació de funcionament que han subscrit tots els membres.
    - Fotocòpia compulsada del DNI de les persones associades i del NIF de l’agrupació, en cas de disposar-ne.
    - Document subscrit per tots els membres de l’agrupació en què es facin constar expressament els compromisos d’execució que assumeix cadascun.
    - Nomenament d’un representant o apoderat únic de l’agrupació, amb poder suficient per complir les obligacions que corresponen a l’agrupació com a beneficiària.
    - Document subscrit per tots els membres de l’agrupació en què es faci constar el compromís de no dissoldre l’agrupació fins que no hagi transcorregut el termini de prescripció que preveu l’article 22 del Decret legislatiu 1/2005, de 24 de juny, pel qual s’aprova el Text refós de la Llei de finances de la comunitat autònoma de les Illes Balears, i els articles 57 i 60 del Decret legislatiu 2/2005, de 28 de desembre, pel qual s’aprova el Text refós de la Llei de subvencions.
    f) Sol•licitud de transferència bancària (imprès TG 002) o document acreditatiu de la titularitat del compte bancari. En el cas d’agrupacions sense personalitat jurídica, haurà de presentar les sol•licituds de transferència bancària cada membre de l’agrupació.
    g) Full d’assentament del vaixell actualitzat, expedit per Capitania Marítima.
    h) Certificat emès per Capitania Marítima acreditatiu de l’activitat pesquera a la qual es refereix la lletra d), punt 2 de l’apartat tercer.
    i) Certificat del Registre Mercantil, acreditatiu que el vaixell està lliure de càrregues i gravàmens.
    j) Qualsevol altra documentació que s’estimi necessari.
