Aids for the national programs of eradication of illnesses animal, corresponding to l’any 2012

L’objecte d’aquestes aids it is the compensation of determinate costs of the necessary performances for power to carry out the national programs of surveillance, eradication and control of the illnesses of each animal species, that are specified in the annual Programs, pass marks for the General Direction of Rural and Sea Environment through Resolution of 29 February 2012.

Addressees

1. They can have the consideration of direct beneficiaries and ask for the foreseen aids in this Resolution the Groups of Sanitary Defense (ADS) that in the moment d’acabament of the deadline of requests presentation, the following requirements fulfill:

a) That they are legally constituted and recognized, in accordance with the that s’estableix within the framework of what foresees Royal decree 842/2011, of 17 June (BOE no. 168, of 14 July 2011), l’Ordre of the counselor d’Agricultura and Fishing, of 26 May 1992, for which the farming Groups of Sanitary Defense of the Balearic Islands are regulated, that was modified through l’Ordre of 3 July 2001 and was complemented through l’Ordre of the counselor d’Agricultura and Fishing, of 16 March 2007.
b) That d’agrupacions of farming defense are communicated to the national Register.

c) That stockbreeders are integrated by headlines d’explotacions in activity and that the exploitations have the condition of PIME, d’acord with l’annex I of the Regulations (CE) no. 800/2008 of the Commission, of 6 d’agost of 2008, by which categories d’ajudes compatible with the common market are declared determinate, in application of the articles 87 and 88 of the CE Treaty to the state aids in the small and medium undertaken ones.

L’acreditació of the fulfillment of the requirements in the points to) and b) mentioned it will be carried out d’ofici on the part of the FOGAIBA, in front of the competent organs of the Ministry of Agriculture, Environment and Territory, with previous l’autorització of l’interessat. In the event of not authorizing this check, s’hauran of showing the corresponding certificates.

Requisites

2. Besides the requirements established in the former points, s’han of fulfilling the foreseen requirements in l’Ordre of the counselor d’Agricultura and Fishing, of 10 March 2005, for which s’estableixen the bases regulatory of the subsidies in the sectors agricultural and fishing, as well as those that legislative Decree 2/2005 establishes, of 28 December, for which s’aprova the Text revised of the Law of subsidies.

3. The general requirements established in the point 1 s’han of maintaining during a deadline d’un year, counted out from the date of the resolution of concession of l’ajuda.

4. The persons, entities and associations that meet at one of the prohibitions established in l’article 10.1 and 10.2 of the legislative Decree 2/2005, of 28 December, for which s’aprova the Text revised of the Law of subsidies, they can not be beneficiaries for the foreseen subsidies in this Resolution. It is necessary to justify that not s’està subjected to these prohibitions in the way established in l’article 10.6 of the legislative Decree 2/2005, of 28 December, before mentioned.

5. D’acord with what orders l’article 10.1 e) of legislative Decree 2/2005, of 28 December, will be considered that the beneficiaries are informed of the tributary duties and with the Social Security when it is checked out what orders l’article 38 of the Decree 75/2004, of 27 d’agost, of deployment of determinate aspects of the general Law of finances and laws of budgets of the autonomous community of the Balearic Islands, as well as the articles 18 and 19 of Royal decree 887/2006, of 21 July, for which s’aprova the Regulations of Law 38/2003, of 17 November, general of subsidies. The circumstance d’estar al corrent of the tributary duties —estatals and autonòmiques— and with the Social Security s’ha d’acreditar before that is dictated the proposal of resolution for which grants l’ajuda to itself.
L’acreditació of the fulfillment d’aquest requirement will be carried out through the presentation of the foreseen certifications in l’article 22 of the Royal decree 887/2006. However, the interested person will be able to authorize the FOGAIBA and/or the Ministry d’Agricultura, Environment and Territory for the check d’ofici of the fulfillment of the mentioned requirement, and in this case the presentation of the corresponding certificates will not be necessary. When the applicant of l’ajuda is not in the former paragraph forced to presenting the declarations or documents that the foreseen duties refer to, s’acreditarà its fulfillment through responsible declaration.

6. In accordance with what he orders l’article 27 of the Law 12/2006, of 20 September, for the woman, will not be able to be either beneficiaries for the foreseen subsidies in this Resolution, the sanctioned physical or juridical persons or convicted persons for firm administrative resolution or judicial sentence for salary discrimination, moral harassment or any type of unequal deal, due to sex, in l’àmbit of the work relations.
