The object aids of the present call have as a purpose the funding of the definite paralyzation of the activities of fishing boats fishing of the modalities d’arrossegament, encirclement, trawl line of surface and minor arts, whenever this paralyzation forms part d’un plan d’ajustament of l’esforç pesquer, established d’acord with l’article 21 to) of the Regulations (CE) no. 1198/2006, or in a plan of dismantlement, of duration equal or inferior to two years, d’acord with l’article 23.2 of the Regulations (CE) no. 1198/2006.
Territorial L’àmbit d’aplicació of the aids is the autonomous community of the Balearic Islands.
Addressees
Beneficiaries for the aids summoned through this Resolution will be able to be the physical or juridical persons, communities of goods or any other type d’agrupació that carries out the foreseen performances to the present Resolution and who, in the moment of presentation of the request d’ajuda, is owners of fishing boats.
Requisites
The fishing boats, like this like fishing l’activitat to develop, they will have to fulfill the following requirements:
a) Ten or more years have to have d’antiguitat. L’edat of the calculation has to be the d’entrada in service.
b) S’han of maintaining even the end in the same census of modality from l’inici of l’expedient of definite paralyzation.
c) Have d’estar inscribed to the Third List of the official Register of registration of boats and in the census of the Operating Fishing Fleet.
d) They have to have its basis port in the Balearic Islands.
e) Have exercised d’haver fishing l’activitat at least during 90 days of fishing in each of the two periods of twelve months former to the date of definite paralyzation request or at least 120 days of fishing in the last year to the date of presentation of the request of paralyzation definite.
f) Have d’estar free of loads and taxes. For the purpose of concession, n’hi have enough that se’n guarantees the cancellation or presents express authorization of credit l’entitat by which the definite paralyzation is allowed.
g) Not have d’estar offered as a casualty for a new construction.

The maximum deadline to dictate the express resolution it is from six months, from l’acabament of the deadline of requests presentation.

Presentation of request
The interested persons who fulfill the foreseen requirements in this call will be able to present the requests.
Periods: The deadline of requests presentation of the aids, summoned through this Resolution, will be since the day following of the date of its publication and he will finish day 30 December 2011.
Place: The requests have d’anar addressed to the president of the Background of Guarantee Agricultural and Fishing of the Balearic Islands and s’hauran of showing in the register of the FOGAIBA, or to any of the registers that l’article 38.4 of Law 30/1992 foresees, of 26 November, of juridical regime of the public administrations and of the common administrative procedure.
Documentation:
These requests have d’anar accompanied of the following documentation:
a) Certified photocopy of the DNI, NIF or NIE of the applicant.
b) Certified photocopy of the DNI of the legal representative, if n’és the case.
c) Photocopy certified of the document constitutive of l’entitat or social statutes duly inscribed in the corresponding register or registral certificate d’inscripció of the mentioned documents.
d) Document crediting of the representation with which that one who signs the request performs, if n’és the case. This accreditation has d’estar in force in the moment of the request.
e) In the case d’agrupacions without legal status, also s’ha d’aportar:
- Document in which the rules or the regulation of functioning that all members have subscribed are reflected.
- Certified photocopy of the DNI of the associated persons and of the NIF of l’agrupació, if orders some.
- Document subscribed by all the members of l’agrupació in which the commitments d’execució that each assumes are made figure itself expressly.
- Representative nomination d’un or only representative of l’agrupació, with sufficient power to fulfill the duties that correspond to l’agrupació as a beneficiary.
- Document subscribed by all the members of l’agrupació in what the commitment not to dissolve l’agrupació until it has not gone by the deadline of prescription is made be itself evident that l’article 22 of the legislative Decree foresees 1/2005, of 24 June, for which s’aprova the Text revised of the Law of finances of the community autonomous of the Balearic Islands, and the articles 57 and 60 of legislative Decree 2/2005, of 28 December, for which s’aprova the Text revised of the Law of subsidies.
f) Request of transfer order (form TG 002) or document crediting of the titularity of the bank account. In the case d’agrupacions without legal status, each member of l’agrupació will have to show the requests of transfer order.
g) Sheet d’assentament of the updated boat, sent by Maritime Captaincy.
h) Certificate issued by Maritime Captaincy creditable of fishing l’activitat that the e letter refers to), point 2 of l’apartat third.
i) Certificate of the Business Register, creditable that the boat is free of loads and taxes.
j) Any other documentation than necessary s’estimi.
