Aids of mínimis to replant trees, year 2011.
(Increment of credits).

Resolution of the president of the Background of Guarantee Agricultural and Fishing of the Balearic Islands (FOGAIBA) d’1 of February of 2012 for which s’incrementa the foreseen credit to the Resolution of the president of the Background of Guarantee Agricultural and Fishing of the Balearic Islands (FOGAIBA) of 4 October 2011 for which aids of minimis are summoned, for exercise 2011, to replant trees.

Domain

L’objecte d’aquesta line is to preserve the natural values, like this how to achieve the maintenance d’aquests trees as own landscape elements, foreseen objective in the pilo program of sustainable development in the Balearic Islands.

Addressees

They can be beneficiaries for the foreseen aids in this Resolution, the persons who in the moment d’acabament of the deadline of requests presentation are in one of the following suppositions:
a) Agricultural holders d’explotacions with precincts d’ametlers affected by fungi of wood that apricot trees replant in the allotment, fig trees and/or garrovers. The affected precincts have d’estar placed in the perimeter d’afectació of the fungus, delimited by the General Direction of Rural and Sea Environment.
b) Agricultural holders d’explotacions with precincts d’ametlers affected by the forest fires that replant with ametlers or garrovers the affected precinct. To demonstrate this extreme s’haurà of showing copy of l’acta of l’incendi sent by competent l’autoritat or to request an inspection of the affected precincts.
c) Agricultural holders d’explotacions with precincts affected for worm any main part (Capnodis tenebrionis) and that d’albercoquers affected, in another precinct, replant the plantation.
d) Titular agricultural d’explotacions that they replant for illness or death of l’arbre: apricot trees, ametlers, fig trees and/or garrovers.

Requisites

The precinct where it is sown again has d’estar inscribed to name of the beneficiary in the general Register agricultural d’explotacions of the Balearic Islands before d’acabar the deadline of requests presentation.

Besides the requirements established in the former points, s’han of fulfilling the foreseen requirements in l’Ordre of the counselor d’Agricultura and Fishing, of 10 March 2005, for which s’estableixen the bases regulatory of the subsidies in the sectors agricultural and fishing, as well as those that legislative Decree 2/2005 establishes, of 28 December, for which s’aprova the Text revised of the Law of subsidies.

The general requirements established in the point 1 s’han of maintaining during a deadline d’un year counted out from the date of the resolution of concession of l’ajuda.

Requests:
The deadline of requests presentation he will start to count out since the following day in the publication in the BOIB of the present call and will end on 15 November 2011.
The requests d’ajuda s’han d’ajustar to the minimum contents that call appears in l’annex I d’aquesta, the model of which it is at the disposal of the interested persons consulting the web page http://www.caib.es or to the headquarters of the FOGAIBA, of the Ministry d’Agricultura, Environment and Territory and to the Delegations local.

The requests will be shown in the register of the FOGAIBA, in the register of the Ministry d’Agricultura, Environment and Territory or of any of the ways that foresees l’article 38.4 of Law 30/1992, of 26 November, of juridical regime of the public administrations and of the common administrative procedure.

All requests have d’adjuntar the following documentation:
a) Physical persons:
— Certified photocopy of the DNI of the applicant.
— In its case, certified photocopy of the DNI of the representative and document crediting of the representation.
— Request of transfer order (form TG 002) or document issued by bank l’entitat creditable of the titularity of the bank account.

b) Juridical persons:
— Certified photocopy of the NIF of the applicant.
— Certified photocopy of the DNI of the representative and document crediting of the representation.
— Request of transfer order (form TG 002) or document issued by bank l’entitat creditable of the titularity of the bank account.
— Certified photocopy of the statutes, of the regulations or of l’escriptura of constitution of l’entitat, correctly inscribed in the corresponding register.
c) In the case d’agrupacions without legal status, also s’ha d’aportar:
- Document in which the rules or the regulation of functioning that all members have subscribed are reflected.
- Certified photocopy of the DNI of the associated persons and of the NIF of l’agrupació, if se’n has.
- Document subscribed by all the members of l’agrupació in which there is constancy expresses of the commitments d’execució that each assumes d’ells.
- Representative nomination d’un or only representative of l’agrupació with sufficient power to fulfill the duties that correspond to l’agrupació as a beneficiary.
- Document subscribed by all the members of l’agrupació in what s’hi the commitment not to dissolve l’agrupació until it has not gone by makes to be evident the deadline of prescription that he foresees l’article 22 of the legislative Decree 1/2005, of 24 June, for which s’aprova the Text revised of the Law of finances of the community autonomous of the Balearic Islands, and the articles 57 and 60 of legislative Decree 2/2005, of 28 December, for which s’aprova the Text revised of the Law of subsidies.
- Request of transfer order (form TG002) or document issued by bank l’entitat creditable of the titularity of the bank account. If does not have account to name of l’agrupació, s’ha d’aportar this document of each of the members.
d) If n’és the case, declaration responsible for not being in the point 6 of l’apartat third forced to showing the declarations or documents foreseen.
