Ajudes per a la transformació i la comercialització dels productes de la pesca i l’aqüicultura de les Illes Balears, any 2011

S’aprova la convocatòria d’ajudes, corresponent a l’any 2011, destinades a la transformació i la comercialització dels productes de la pesca i de l’aqüicultura, d’acord amb el que estableix l’Ordre de la consellera d’Agricultura i Pesca, de 17 de juny de 2008, per la qual s’estableixen les bases reguladores de la concessió de subvencions en el marc del programa del Fons Europeu de Pesca, publicada en el BOIB núm. 90, de 28 de juny de 2008, modificada per l’Ordre de la consellera d’Agricultura i Pesca, de 30 de juliol de 2009, publicada en el BOIB núm. 119, de 15 d’agost de 2009, en el marc del programa operatiu del Fons Europeu de Pesca, aprovat per la Comissió, en data 13 de desembre de 2007.
L’àmbit territorial d’aplicació de les ajudes és la comunitat autònoma de les Illes Balears.

Addressees

Podran ser beneficiaris de les ajudes convocades mitjançant aquesta Resolució, les empreses que siguin públiques, semipúbliques o privades i que tenguin el domicili fiscal a les Illes Balears en el moment de la presentació de les sol·licituds i que duguin a terme les actuacions de la present Resolució, sempre que siguin empreses de qualcuna de les següents modalitats:
a) Microempreses, petites o mitjanes empreses definides a l’article 3, lletra f) del Reglament (CE) núm. 1198/2006 del Consell, de 27 de juliol de 2006, relatiu al Fons Europeu de Pesca;

b) les empreses no contemplades per la definició abans esmentada, amb menys de 750 empleats i amb un volum de negoci inferior a 200 milions d’euros.

Presentation of requests


    The interested persons who fulfill the foreseen requirements in this call will be able to present the requests, which will have to have the minimum contents that appear in l’annex I, and which have to address the president of the Background of Guarantee Agricultural and Fishing of the Balearic Islands.

    Periods: The deadline of requests presentation of the aids summoned through this Resolution it will be from the following day of the date of the publication and will end on 27 July 2011.

    Place: The requests have to be shown in the register of the FOGAIBA, in the register of the Ministry of Presidency or in any of the registers that foresees l’article 38.4 of Law 30/1992, of 26 November, of juridical regime of the public administrations and of the common administrative procedure.

    Documentation:
    These requests have d’adjuntar the following documentation:
    certified a)Fotocòpia of the DNI, NIF or NIE of the applicant.
    certified b)Fotocòpia of the DNI of the legal representative, if n’és the case.
    c)Fotocòpia certified of the document constitutive of l’entitat or social statutes duly inscribed in the corresponding register, or registral certificate d’inscripció of the mentioned documents.
    d)Document crediting of the representation with which that one who signs the request performs, if n’és the case. This accreditation has d’estar in force in the moment of showing the request.
    e)En the case d’agrupacions without legal status, also s’ha d’aportar:
    -Document in which the rules or the regulation of functioning that all members have subscribed are reflected.
    -Certified photocopy of the DNI of the associated persons and of the NIF of l’agrupació, in the case that se’n orders.
    -Document subscribed by all the members of l’agrupació in which the commitments d’execució that each assumes are made figure itself expressly.
    -Representative nomination d’un or only representative of l’agrupació, with sufficient power to fulfill the duties that correspond to l’agrupació as a beneficiary.
    -Document subscribed by all the members of l’agrupació in what the commitment not to dissolve l’agrupació until it has gone by the deadline of prescription is made be itself evident that l’article 22 of the legislative Decree foresees 1/2005, of 24 June, for which s’aprova the Text revised of the Law of finances of the community autonomous of the Balearic Islands, and the articles 57 and 60 of legislative Decree 2/2005, of 28 December, for which s’aprova the Text revised of the Law of subsidies.
    f)Sol·licitud of transfer order (form TG002) or document crediting of the titularity of the bank account. In the case d’agrupacions without legal status, each member of l’agrupació will have to show the requests of transfer order.
    g)Tres budgets or bills pro forma of the elements to acquire or works to carry out, when the amount exceeds 30.000,00 euros in the event of cost for execution d’obra, or of 12.000,00 euros in the event of supply of goods d’equipament or rendering of services. In the case that the investment already s’hagi carried out in the moment of the presentation of the request, s’haurà d’acreditar the justification of the expense in agreement that foreseen in l’apartat eleventh.

    i)Si n’és the case, plan d’actuació for the effective equality of women and men.
    j) Certification of the number of workers and volume of business of l’empresa, d’acord with the Recommendation 2003/361/CE of the Commission, of 6 May 2003.
    k) Project signed by a competent technician and visa, depending on the nature of the investment if n’és the case.
    l) If n’és the case and in the works that require it like this, the intervention d’un technical doctor; s’aportarà certification d’inici d’obra issued by the director of the project with the indication of the date of beginning of the subsidized investments. When this direction d’obra is not necessary, s’aportarà the corresponding license d’obres.
    m) When it is about projects with even productive, study economic-financial crediting of its economic feasibility.
    n)Qualsevol another documentation than necessary s’estimi.

    Requisites:
    When d’agrupacions of physical or juridical persons is treated without own legal status, s’han of making have evidence about, to the request as well as to the resolution of concession, expressly the commitments d’execució that each member of l’agrupació assumes and also l’import of the subsidy that s’ha d’aplicar for each, which have equally the consideration of beneficiaries.
    In any case, s’ha of appointing a representative or representative unique of l’agrupació, with sufficient power to fulfill the duties that, as a beneficiary, correspond to l’agrupació. L’agrupació will not be able to dissolve until it has not passed the deadline of prescription that the articles 39 and 65 of the Law foresee 38/2003, of 17 November, general of subsidies.

    3.A more of the requirements established formerly, the beneficiaries for the aids will have to fulfill the foreseen requirements in l’article 11 of l’Ordre of the counselor d’Agricultura and Fishes, of 17 June 2008, for which s’estableixen the bases regulatory of the concession of subsidies within the framework of the program of the European Background of Fishing (FEP), as well as also the ones established in legislative Decree 2/2005, of 28 December, for which s’aprova the Text revised of the Law of subsidies.

    4.D’acord with what orders l’article 10.1 e) of legislative Decree 2/2005, of 28 December, it will be considered that the beneficiaries feel al corrent of the duties tributary and with the Social Security when it is verified what orders l’article 38 of the Decree 75/2004, of 27 d’agost, of development of determinate aspects of the general Law of finances and laws of budgets of the autonomous community of the Balearic Islands, as well as the articles 18 and 19 of Royal decree 887/2006, of 21 July, for which s’aprova the Regulations of Law 38/2003, of 17 November, general of subsidies. The circumstance d’estar al corrent of the tributary, state and autonomic duties, and with the Social Security, will have to agree accredited with anteriority on dictating the proposal of concession resolution of l’ajuda, as well as in the moment of the payment.
