Inscription, modification and cancellation in the Register of Stable Couples of the Balearic Islands.

Addressees

All the citizenship of the Balearic Islands.

Requisites

- Emancipated adult or minor being/emancipated.
- Not having, the members of the couple, relation of kinship in a straight line for consanguinity or adoption (grandparents, parents, children), nor collateral for consanguinity or adoption until the third degree (brothers, uncles, nephews).
- Not to be tied by wedding bond, him to suggest, to be single boy/single girl, widower/widower or divorced man/divorced woman.
- Not forming stable couple with another person, if this couple is registered and formalized duly.
- One of the two members (at least), to have Balearic civil neighborhood. In cases of foreign persons, only those that, having residence in the Balearic Islands, acquire the Spanish nationality can acquire the Balearic civil neighborhood.
- Both members, to be subjected in an express way to the regime that Law 18/2001 establishes, of 19 December, of stable couples.
- Both members, to declare stable, without conditions and with character of permanence the will of constituting itself in couple.

Rate of inscription in the Register of stable Couples of the Balearic Islands (20 € -Law 15/2012 of general budgets of the CAIB for l?any 2013).

To formalize the rate of inscription in the Register of Stable Couples of the Balearic Islands the model has to be filled in with form DUI-046, in which people can access if it presses aquí.

    The Register has to check out the accuracy and the sufficiency of the brought data and, if it is necessary, has to require the interested persons who in a deadline of 10 days, meters from the notification of the requirement, amend the faults or bring the documents that offend to him, with indication that if they do not make it, it will be considered that they desist from its request.
    Checked out the accuracy and the suficència of the data brought, the will has to be required to both members of the couple that, in the deadline of a month, and before the person responsible for the Register, in front of a notary/notary or in front of a batle/batlessa assistit/assistida for the secretary/secretary, they formalize together and of written form of constituting itself in couple in a relation of affectivity analogous in the conjugal one, without conditions and with character of permanence.
    For the recognition of the effects of the constitution of the stable couple it is necessary that it registers in the Register. The date that marks the effects of the constitution is that of the declaration of the will formalized in accordance with the former point.
    The person responsible of the Register has to elevate the proposal of resolution of constitution and inscription of the stable couple in the titular person from the Ministry of Health, Family and Social Welfare, that the corresponding resolution has to dictate.
    If in the maximum deadline of three months -meters from the formalization of the constitution of the couple made in front of the responsible for the Register or from the date of entry in the Register foreseen in the section 4 of this article- any resolution has been dictated, the request of inscription has to understand itself loved.
    Against the resolutions dictated by the titular person of the Ministry of Health, Family and Social Welfare, which finish the administrative way, the foreseen resources can be lodged legally.
    Once dictated the corresponding resolution favorable to the practice of an inscription, it has to note down in the General Book of the Register.

    Documentation which it is necessary to show:
    The request of inscription in the Register of Stable Couples implies the beginning of an administrative report. This request has to go accompanied of the following documents:
    a) Original and copy of the documents of identification of the members of the couple.
    b) Certified from the Register Office or public writing of emancipation from the members, if it is necessary.
    c) Certificate updated from the Register Office with which it is proved that any wedding bond with any other person is maintained.
    d) Certificate crediting of the Balearic civil neighborhood of one of the members of the couple.

    Requisites:
    In the sheet of request, the persons sign that:

    They do not have any direct relation of kinship in line for consanguinity or adoption, or collateral for consanguinity or adoption until the third degree.

    They do not form stable couple with any other person registered and formalized duly in the Register of Stable Couples of the Balearic Islands.

    They undergo the regime that Law 18/2001 establishes, of 19 December, of stable couples.

    At least a member of the couple has Spanish nationality and Balearic civil neighborhood.
