Requisites

In the partial voluntary retirement the company has to agree simultaneously on a contract of relief, with object of substituting the day of work that the worker who retires partially stops carrying out.

Of the relieved worker who retires anticipatedly:
- Minimum age: until the 31st December 2012 it has to have 60 years and 6 months. If it has had the condition of mutualist before the 1st January 1967 he can retire anticipatedly at 60 years.
- It has to have a period of antique in the company, at least, of 6 years immediately former to the date of partial retirement.
- It has to accredit a period of lack of 30 years of quotation.
- It has to be hired with day at complete time.
- The percentages in which the reduction in day can be produced are understood between a minimum of 25% and a maximum of 75% related at its day of work.

Of the relay runner worker:
- Corresponding d’ocupació has to be inscribed as free in the office.


Of the contract of employment of relief:
- It has to be formalized in writing and in official model.
- The duration of the contract has to be equal in that of the time that he offends to the worker relieved for having the age of 65 years.
- The day of the relay runner worker has to be, at least, equal to the reduction in the day agreed on by the worker relieved of a similar category in the same place of work or in another.

Procedure previous to the partial retirement: the workers who want to resort to this system of retirement have to request it, through the corresponding ministry. Although the collective Agreement does not establish the procedure a deadline of anticipation to start, it is recommended that the formalities start six months before the anticipated partial retirement.
To start the formalities, the worker that he intends to retire has to show:
- photocopy of the DNI,
- original or photocopy collated of the certificate since birth,
- original or photocopy collated of the work life.

The ministry of origin has to send immediately the request in the competent ministry on the subject of public function.

Before formalizing the recruitment it is preceptive that the works committee issues a report.

In accordance with the criteria of the INSS, if the sustituït worker, in the moment of the recruitment or later, valid the work relation, figure of high in another different place of work of that has been hired for substituting the retired worker, or in another regime of the Social Security different of the general, can not be considered valid as free, even if in the moment of the recruitment it was inscribed as a prosecutor of employment.
